Partner Jim Sinunu presented, “Retailers Beware: Avoiding Potential Hazardous Product Lawsuits” at the Environmental & Emerging Claim Manager Association (EECMA) Conference and Meeting  held May 2-4, 2012 in Captiva Island, FL.

Mr. Sinunu examined a retailer’s liability and duty to warn consumers when selling products from manufacturers or distributors that may be hazardous but have insufficient labeling.  Retailers such as department stores, hardware stores, sporting goods stores and grocery stores face a variety of challenges to avoid being held responsible for such defective products.  Mr. Sinunu discussed strategies for retailers to minimize exposure to retailers, and provided an examination of issues from recent asbestos and other toxic tort cases.
